Terms of sale

Plain terms for a small shop. Buying from us means you agree to what's below — it's short, and we've tried to write it in English rather than boilerplate.

Who you're buying from

Theory of Beauty LLC, an Ohio limited liability company in Galloway, Ohio. "We" and "us" mean that company; "you" means you, the customer. These terms cover purchases made through shoptheoryofbeauty.com.

Prices and tax

Prices are in US dollars and are shown before tax. Ohio sales tax of 8% is added at checkout, on its own line. Shipping is a flat $5, free over $50 — see Shipping & returns for the details.

We can change prices at any time, but never on an order you've already placed. If a price on the site is obviously wrong — a decimal in the wrong place, a $38 bundle listed at $3.80 — we may cancel the order and refund you in full rather than honor it. We'll email you if that happens.

Placing an order

An order is an offer to buy. It's accepted when we send you a confirmation email. Until then we may decline it — if we're out of stock, if the order looks fraudulent, or if we can't ship to your address. If we decline, you're refunded in full and charged nothing.

Everything is made in small batches by hand, so occasionally something sells out between your click and our packing table. If that happens we'll email you and either hold the order until the next batch or refund it — your call.

Payment

Payments are processed by Square. We never see or store your card number. By checking out you also accept Square's terms for the payment itself.

Discount codes

Discount codes are for the person they were given to and can't be resold, published, or combined with other offers unless we say so. We can withdraw a code at any time, and we may cancel orders that used one improperly.

About the products — please read this part

Our products are cosmetics, not drugs. They're made to moisturize and condition skin and beard hair. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and nothing on this site should be read as a medical claim or as medical advice.

Everything we make is fragrance-free and short on ingredients precisely because we made it for reactive skin. That said, any ingredient can irritate someone. So:

  • Read the full ingredient list before you use a product — it's printed on every label and listed on this site.
  • Patch test first if your skin is reactive: dab a little on the inside of your forearm and wait a day.
  • Stop using it if you get irritation, redness, or a rash, and talk to a doctor if it doesn't settle.
  • For external use only. Keep it away from eyes, and out of reach of children.
  • Check with your doctor first if you're pregnant, nursing, buying for a young child, or under care for a skin condition.

Products are best used within 6 months of opening. Store them out of direct sun.

What we promise, and what we don't

We promise the products are made as described, from the ingredients we list, blended and bottled by us in Galloway, Ohio. If a product arrives damaged, spoiled, or not as described, we'll replace or refund it — see Shipping & returns.

What we can't promise is how your particular skin will respond. Skin varies enormously, and no honest maker can guarantee a result. Beyond the promises above, the products are provided as they are. To the extent Ohio law allows, we disclaim other implied warranties, including merchantability and fitness for a particular purpose.

Nothing here takes away rights you have under consumer protection law that can't be waived — and we're not trying to.

Limits on liability

To the fullest extent the law allows, our total liability for any order is limited to what you paid for that order. We're not liable for indirect or consequential losses.

This limit does not apply to injury caused by our own negligence, to fraud, or to anything else the law doesn't permit us to limit. We're a family business and we intend to stand behind what we make — if something goes wrong, write to us before anything else.

Reviews you submit

If you leave a review, you're giving us permission to publish it on this site alongside the display name you chose. Keep it honest and your own; we don't publish anything abusive, off-topic, or written by someone who never bought the product. We may decline to publish a review, and we'll take yours down on request — just email us.

Using this site

The text, photographs, logo, and design here belong to Theory of Beauty LLC. Please don't copy them for commercial use without asking. Don't try to break, scrape, or overload the site — and don't attempt to interfere with the checkout.

If something goes wrong between us

Email us first. Nearly everything gets solved in one message, and we'd much rather fix it than argue about it.

If it can't be resolved that way, these terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, and any dispute belongs in the state or federal courts of Franklin County, Ohio.

We don't force you into arbitration and we don't ask you to waive a class action. If a court finds one part of these terms unenforceable, the rest still stands.

Changes

We may update these terms; the date at the top tells you when we last did. The version in effect when you place your order is the one that governs it — a later change never applies retroactively to a purchase you already made.
